Betavine

The following terms and conditions (‘Terms’) apply to each Betavine Student Competition (‘Competition’) which gives you (“You”) the chance to win a prize (‘Prize’). Each Competition is run by Vodafone Group Services Limited, Vodafone House, The Connection, Newbury, RG14 2FN (‘Vodafone’), unless a different company is identified as the Competition’s sponsor on the Competition entry page – such Competitions are run by the relevant companies, with Vodafone providing administrative support. In these terms, “Sponsor” refers to the company which runs the Competition which You enter.

By entering a Competition You will be deemed to have understood these Terms, to have agreed to be bound by them and accept that Your participation in the Competition is subject to these Terms. Please read these Terms carefully as they contain important information regarding your legal rights, remedies and obligations.

1. Eligibility Criteria and Participation

1.1To be eligible to participate in a Competition:

1.1.1 You must have read and agreed to the Betavine Terms of Use and Privacy Policy. You will be deemed to have agreed to these by entering into a Competition;

1.1.2 You must be at least 13 years old and a current student at a recognised institute of education (‘Institute’) at the date of Your entry, including but not limited to schools, colleges and universities;

1.1.3 Your University must be willing for You to participate in the Competition and You must provide the name and contact details of Your supervisor at Your University (‘Supervisor’). You are deemed to obtain all necessary consents from Your University and Supervisor to participate in the Competition. At the Sponsor’s request You must provide proof of Your enrolment at Your University;

1.1.4 You must not be (and none of Your parents, siblings or children can be) a current employee or contractor of Vodafone or the Sponsor (if different);

1.1.5 You will need to complete and submit the registration form which can be found on www.betavine.net;

1.1.6 You will need to submit Your registration form and upload your application by the closing date of the relevant Competition and the date on which You upload Your application will be deemed Your ‘Entry Submission Date’;

1.1.7 You must only submit one entry by the closing date for that Competition;

1.1.8 Your entry must be completely Your own original work or (b) You must have the express consent of all authors of Your entry to submit such entry to the Competition; and

1.1.9 Your entry must not have been submitted in a previous Competition, and must be compatible with a commonly-available mobile device.

1.2 Prizes are awarded directly to the winning student(s) where possible. In some countries it may be necessary for the Sponsor to issue Prizes to the winning student(s) via their University or another intermediary. The Sponsor will inform such students at the appropriate time.

1.3 If the Prize is a cash Prize and the winning entry was submitted by a team, then the Prize will be divided by the number of students in that team and paid accordingly to each winning team member. If the Prize is not a cash Prize then the Prize will be sent to the registered entrant.

1.4 Each Competition is operated through the web site located at www.betavine.net.

1.5 Vodafone’s computer record of Your registration details (including Your Entry Submission Date, University and Supervisor) will be considered the accurate record of Your entry. Any entry that is not in accordance with these Terms will be void. The Sponsor reserves the right to reject any entry that it considers, in its sole discretion, to be incomplete, inaccurate, corrupted or otherwise unsuitable. When submitting an entry to the Competition, personal information may be processed by Vodafone and the Sponsor (if different). You agree that the personal information (including Your personal information and that of Your Supervisor) which You provide in the course of entering into a Competition can be processed for the sole purpose of administering the Competition and it will not be disclosed to any other third parties. Please see the Betavine Privacy Policy for further details.

1.6 Each Competition is free to enter.

1.7 If You cease to be a student at Your University at any time during the Competition (other than due to graduation) Your entry will be disqualified and will not be eligible to win the Prize.

2. Judge’s Decision is Final

The winner(s) of each Competition will be decided by the Sponsor in its sole discretion and no correspondence shall be entered into. The Sponsor’s decision is final.

3. Prize

3.1 Any Prize that is not cash may not be sold, transferred or exchanged by a winner and no other cash alternative is available. The Sponsor reserves the right to substitute any Prize with one of equal or greater value.

3.2 The winner(s) of each Competition will be contacted directly by email or telephone within 30 days of being identified. If despite reasonable efforts the Sponsor is unable to contact a relevant winner within that period, the Sponsor reserves the right to choose a substitute winner.

3.3 The name of the Competition winner(s) will be available on www.betavine.net.

3.4 Prizes will be issued within 45 days of contact being made by the Sponsor in accordance with section 3.2, subject to the requirement that all relevant information necessary for the Sponsor to issue the Prize has been provided.

4. Publicity and Hosting

It is a condition of Your entry that: (a) Vodafone and the Sponsor (if different) has(ve) the right to publicise Your name for any matter or promotion which is incidental to the Competition and/ or the Prize, including publicity by way of radio broadcast, local press, television or Internet/intranet; and (b) Vodafone has the right to host Your application on www.betavine.net in accordance with the Betavine Terms of Use.

5. Liability

5.1 Neither Vodafone nor the Sponsor is liable for any damage, loss or disappointment suffered by Your participation in the Competition other than damages for death or personal injury caused by Vodafone’s or the Sponsor’s negligence.

5.2 Vodafone and the Sponsor expressly exclude any liability caused by loss or delay of entries or database or Betavine failure or failure to record Your or Your University’s details, as well as any liability for failure to contact You.

5.3 The Prize offered will be accepted in the knowledge that the winner may become liable to local tax contributions and any Prize awarded may have to be declared on an annual tax return as required. Any tax liability will be the responsibility of the winner and the winner must pay any local taxes due

6. General

6.1 Vodafone and the Sponsor may issue updates to these Competition Terms from time to time. Any such updates will be posted on the relevant sections of Betavine. If you do not agree to Your entry being considered in the Competition under such revised terms You must notify webmaster@betavine.net that You want to remove Your entry from the Competition.

6.2 Vodafone and the Sponsor reserve the right to cancel or terminate any Competition: 6.2.1 should any cause beyond Vodafone’s and the Sponsor’s control affect the administration or operation of the Competition; and 6.2.3 if the entries to the Competition are of insufficient quantity or quality to allow a meaningful Competition to take place, in the Sponsor’s sole opinion.

6.3 No express or implied term of these Terms is enforceable pursuant to the Contract (Rights of Third Parties) Act 1999 by any person who is not a party to it.

6.4 Unless specifically stated otherwise on the Competition entry page, the Competition is operated in England, is subject to English law and is governed by the exclusive jurisdiction of English courts.
